Welcome to SableRiverGarden ("we," "us," or "our"). The following Terms & Conditions ("Terms") dictate your interaction with our yacht chartering functionalities and our website at sablerivergarden.sbs, managed by SableRiverGarden.
When you secure a charter or make use of our Service, you're adhering to these Terms. Should you find any portion of the terms objectionable, then you must cease use of the Service.
2. Service Overview
SableRiverGarden offers high-end yacht charter services which include, but are not limited to:
- Daily yacht charters
- Evening sailing trips
- Company getaway events
- Exclusive gatherings
- Extended charters
Our services are contingent upon availability and climatic conditions. We reserve the authority to alter or cease our offerings without prior warning.
3. Booking and Reservations
3.1 Reservation Process
For charter reservation, you are required to:
- Be 18 years of age or older
- Provide truthful and comprehensive details
- Submit the initial payment as detailed in the reservation confirmation
- Consent to these Terms & Conditions
3.2 Verification
Your reservation is solidified with the receipt of your payment and our subsequent written confirmation. Service access may be denied at our discretion.
3.3 Charter Availability
Charter services are offered based on the yacht's availability and favorable weather. We strive to match your requested dates and times as closely as possible.
4. Financial Conditions
4.1 Costs
All fees are indicated in € and are comprehensive of taxes unless specified otherwise. Fees are adjustable and subject to changes without notification.
4.2 Payment Plan
- Initial deposit: 50% of total cost of the charter required at the time of booking
- Final payment: Must be concluded 48 hours before the scheduled departure
- Any additional fees: Required upon charter completion
4.3 Payment Options
Payment can be processed via major credit cards, wire transfers, and bank checks. All transactions are conducted through secure, encrypted solutions.
5. Cancellation and Reimbursement Protocol
5.1 Customer Initiated Cancellations
- Over 72 hours prior to departure: Full refund excluding handling fees
- Between 24 and 72 hours prior to departure: 50% refund
- Under 24 hours before departure: No refund provided
5.2 Cancellations Due to Weather
In situations where the weather is determined to be hazardous by our captain, we propose:
- An alternative date for the charter at no extra charge
- A complete refund if rescheduling is not viable
5.3 Technical Difficulties
If your yacht encounters mechanical issues, we will endeavour to supply an appropriate replacement. If replacement is not feasible, we will issue a full refund.
6. Safety and Behavioral Guidelines
6.1 Required Safety Measures
Guests must:
- Adhere to all instructions issued by the crew
- Utilize the provided safety gear as needed
- Disclose any health issues that may influence their own security
- Stay within allocated areas on the yacht
6.2 Forbidden Items
Prohibition applies to these items aboard:
- Glassware
- Contraband materials
- Weapons
- Excess beverages (beyond reasonable consumption)
- Pets (with exceptions upon prior approval)
6.3 Decency
Passengers are required to maintain a mannerly comportment throughout their time on board. Should misbehavior pose a threat or spoil the experience for others, we may abbreviate the charter without issuing a refund.
7. Responsibility and Coverage
7.1 Our Accountability
Our financial liability in any situation is restricted to the charter fees you have paid. We are not liable for:
- Injuries sustained from passenger carelessness
- The disappearance or damage of personal belongings
- Secondary, incidental, or punitive losses
- Delays related to weather or other factors outside our control
7.2 Insurance Policies
Comprehensive marine insurance is maintained for our vessels and operations. It is your responsibility to have personal and travel insurance coverage.
7.3 Acceptance of Risk
Participants in our charter services acknowledge the inherent risks involved in maritime ventures and accept accountability for their own safety.
8. Adjustments and Route Alterations
Itinerary, routes, or schedules are subject to adjustments based on climate, safety, or operational needs. We will put forth efforts to deliver similar alternate experiences.
9. Force Majeure
Events beyond our control which may affect delays, cancellations, or adjustments include, but are not limited to:
- Extreme weather events
- Natural catastrophes
- Regulatory directives
- Port shutdowns
- Technical malfunctions
10. Confidentiality and Data Security
We manage your personal information under the guidance of our Privacy Policy. By choosing our services, you agree to the collection and usage of your data as outlined in our Privacy Policy.
11. Proprietary Rights
The contents of our website, such as text, illustrations, trademarks, and other material, are under copyright and trademark law protections. Unauthorized duplication, dissemination, or modification is prohibited without prior consent from us.
12. Jurisdiction
The validity of these Terms is determined by the laws in force in Spain. Any legal proceedings must be carried in the courts of Barcelona, Spain.
13. Amendments to Terms
